Privacy policy

1) INFORMATION ABOUT THE COLLECTION OF PERSONAL DATA AND CONTACT DETAILS OF THE CONTROLLER

1.1 We are pleased that you are visiting our website and thank you for your interest. Below, we inform you about how we handle your personal data when you use our website. Personal data refers to all data through which you can be personally identified.

1.2 The controller responsible for data processing on this website, within the meaning of the General Data Protection Regulation (GDPR), is Montreal Mode. The controller for the processing of personal data is the natural or legal person who, alone or jointly with others, determines the purposes and means of the processing of personal data.

1.3 For security reasons and to protect the transmission of personal data and other confidential content (e.g. orders or inquiries to the controller), this website uses SSL or TLS encryption. You can recognize an encrypted connection by the character string “https://” and the lock symbol in your browser’s address bar.

--------------------------------------------------------------------------------

2) DATA COLLECTION WHEN VISITING OUR WEBSITE

When you visit our website purely for informational purposes—that is, if you do not register or otherwise transmit information to us—we only collect the data that your browser transmits to our server (so-called “server log files”). When you access our website, we collect the following data, which is technically necessary for us to display the website to you:

• The specific web page you have visited

• Date and time at the time of access

• The amount of data sent in bytes

• Source/referrer from which you arrived at our page

• The browser used

• The operating system used

• The IP address used (possibly in anonymized form)

Processing takes place according to Art. 6(1)(f) GDPR on the basis of our legitimate interest in improving the stability and functionality of our website. This data is not shared or used in any other way. However, we reserve the right to examine the server log files at a later date if there are concrete indications of illegal use.

--------------------------------------------------------------------------------

3) COOKIES

To make visiting our website appealing and to enable the use of certain functions, we use so-called cookies on different pages. These are small text files stored on your device. Some of the cookies we use are deleted after the end of the browser session, i.e. after you close your browser (session cookies). Other cookies remain on your device and allow us or our partner companies (third-party cookies) to recognize your browser on your next visit (persistent cookies). When cookies are set, they collect and process certain user information such as browser and location data, as well as IP address values, to varying extents. Persistent cookies are automatically deleted after a specified period, which may differ depending on the cookie.

Some cookies serve to simplify order processes (e.g. to remember the contents of a virtual shopping cart for a later visit). Where individual cookies implemented by us also process personal data, the processing takes place according to Art. 6(1)(b) GDPR either for the performance of a contract or according to Art. 6(1)(f) GDPR for the protection of our legitimate interests in the best possible functionality of the website and a customer-friendly and effective design of the website visit.

We may work with advertising partners who help us make our internet offerings more interesting to you. For this purpose, cookies from our partner companies may also be stored on your hard drive when you visit our website (third-party cookies). If we work with the aforementioned advertising partners, you will be informed individually and separately about the use of such cookies and the scope of the collected information.

Please note that you can set your browser to inform you when cookies are placed so that you can decide individually whether to accept them or to exclude the acceptance of cookies for specific situations or in general. Each browser manages cookie settings differently. The help menu of each browser will explain how to change your cookie settings. You can find these for each browser at the following links:

4) CONTACTING US

When you contact us (e.g. via contact form or email), personal data is collected. The specific data collected when using a contact form is shown on the respective form. This data is stored and used exclusively for the purpose of responding to your inquiry or for contacting you and for the associated technical administration. The legal basis for processing the data is our legitimate interest in responding to your request in accordance with Art. 6(1)(f) GDPR. If your contact is aimed at concluding a contract, then the additional legal basis for the processing is Art. 6(1)(b) GDPR. Your data will be deleted after your inquiry has been processed, provided there are no statutory retention obligations and it can be inferred that the matter in question is definitively resolved.

--------------------------------------------------------------------------------

5) DATA PROCESSING WHEN OPENING A CUSTOMER ACCOUNT AND FOR CONTRACT EXECUTION

Pursuant to Art. 6(1)(b) GDPR, personal data is collected and processed if you provide it to us for the purpose of executing a contract or when opening a customer account. The specific data collected can be seen from the respective input forms. You may delete your customer account at any time by sending a message to the above-mentioned address of the controller. We store and use the data you provide to process the contract. After the contract is fully executed or your customer account has been deleted, your data will be blocked out of consideration for tax and commercial law retention periods and deleted after these periods expire, unless you have expressly consented to further use of your data or a legally permissible further use of the data is reserved by us, about which we inform you below.

--------------------------------------------------------------------------------

6) USE OF YOUR DATA FOR DIRECT ADVERTISING

6.1 Subscription to our email newsletter

If you subscribe to our email newsletter, we will regularly send you information about our offers. The only mandatory information for sending the newsletter is your email address. Providing additional data is voluntary and is used to address you personally. We use the so-called double opt-in procedure for sending newsletters. This means we will only send you an email newsletter once you have expressly confirmed that you consent to receiving the newsletter. We will then send you a confirmation email asking you to click a corresponding link to confirm that you wish to receive newsletters in the future.

By activating the confirmation link, you give us your consent to use your personal data in accordance with Art. 6(1)(a) GDPR. When subscribing to the newsletter, we store the IP address entered by your internet service provider (ISP) as well as the date and time of subscription in order to trace any potential misuse of your email address at a later date. The data collected by us when you subscribe to the newsletter is used exclusively for the purpose of promotional communication in the form of the newsletter. You can unsubscribe from the newsletter at any time via the link provided for this purpose in the newsletter or by sending a corresponding message to the controller mentioned at the outset. Once you unsubscribe, your email address will be immediately removed from our newsletter distribution list unless you have expressly consented to further use of your data or we reserve the right to use data beyond that, which is permitted by law and about which we inform you in this statement.

6.2 Sending the email newsletter to existing customers

If you have provided us with your email address when purchasing goods or services, we reserve the right to regularly send you offers for similar goods or services from our range by email. We do not need to obtain separate consent from you for this. Data processing here is exclusively based on our legitimate interest in personalized direct advertising according to Art. 6(1)(f) GDPR. If you have initially objected to the use of your email address for this purpose, we will not send you any emails. You are entitled to object at any time to the use of your email address for the advertising purpose mentioned above with future effect by notifying the controller indicated above. You only incur transmission costs according to the basic rates. Once we have received your objection, we will stop using your email address for advertising purposes immediately.

--------------------------------------------------------------------------------

7) DATA PROCESSING FOR ORDER HANDLING

7.1 The personal data we collect is shared with the transportation company assigned to deliver the goods as part of the contract execution, to the extent that this is necessary for delivering the goods. We also share your payment data with the financial institution responsible for processing the payment if this is required for handling the payment. Should we use payment service providers, we will explicitly inform you of this below. The legal basis for transferring the data in this case is Art. 6(1)(b) GDPR.

7.2 Use of Payment Service Providers

- PayPal

When paying via PayPal, credit card via PayPal, direct debit via PayPal or—if offered—"purchase on account" or “payment in installments” via PayPal, we transfer your payment data to PayPal (Europe) S.a.r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg (“PayPal”) as part of the payment process. The transfer takes place under Art. 6(1)(b) GDPR and only to the extent necessary for payment processing.

PayPal reserves the right to conduct a credit check for the payment methods credit card via PayPal, direct debit via PayPal or—if offered—"purchase on account" or “payment in installments” via PayPal. For this purpose, your payment data may be shared with credit agencies under Art. 6(1)(f) GDPR on the basis of PayPal’s legitimate interest in establishing your solvency. PayPal uses the outcome of the credit check to decide on whether or not it will provide the respective payment method. Credit reports may contain probability values (so-called score values). Where score values are included in the result of the credit check, they are based on a scientifically recognized mathematical-statistical procedure. Address data, among other data, is factored into these score values. Please see PayPal’s Privacy Policy for more information on data protection, including the credit agencies used: https://www.paypal.com/ca/webapps/mpp/ua/privacy-full

You can object to this processing of your data at any time by sending a message to PayPal. However, PayPal may still be entitled to process your personal data if this is necessary to carry out the payment as agreed.

- SOFORT

If you select the “SOFORT” payment method, payment will be processed by SOFORT GmbH, Theresienhöhe 12, 80339 Munich, Germany (“SOFORT”), to which we transmit the information you provided during the order process along with information about your order under Art. 6(1)(b) GDPR. 10) ONLINE MARKETING

10.1 DoubleClick by Google

This website uses the online marketing tool DoubleClick by Google, operated by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“DoubleClick”).

DoubleClick uses cookies to display ads that are relevant to users, to improve reports on campaign performance, or to prevent users from seeing the same ads multiple times. Google uses a cookie ID to determine which ads have run in which browser and to prevent them from being displayed multiple times. Processing is based on our legitimate interest in optimally marketing our website pursuant to Art. 6(1)(f) GDPR.

In addition, DoubleClick can use cookie IDs to track what are known as conversions related to ad requests—e.g., when a user sees a DoubleClick ad and later uses the same browser to visit the advertiser’s website and make a purchase. According to Google, DoubleClick cookies do not contain personally identifiable information.

By virtue of the marketing tools in use, your browser automatically connects directly to the Google server. We have no influence on the scope and further use of the data collected by Google through the use of this tool, and so we inform you based on our state of knowledge: Through DoubleClick, Google receives the information that you have visited the corresponding section of our website or clicked on an advertisement from us. If you are registered with a Google service, Google may associate your visit with your account. Even if you are not registered with Google or are not logged in, it is possible that the provider obtains and stores your IP address.

If you wish to opt out of participation in this tracking process, you can disable cookies for conversion tracking by setting your browser to block cookies from the domain www.googleadservices.com, at https://www.google.com/settings/ads, noting that this setting will be deleted if you delete your cookies. Alternatively, you may visit the Digital Advertising Alliance website at www.aboutads.info to learn about the setting of cookies and adjust your preferences accordingly. Finally, you can set your browser so that you are notified when cookies are placed and decide individually whether to accept them or to exclude cookies for specific circumstances or in general. If you do not accept cookies, the functionality of our website may be limited.

Google LLC in the USA is certified under the EU-U.S. “Privacy Shield,” ensuring compliance with EU data protection standards.

For further information about DoubleClick by Google’s privacy policies, please see: https://www.google.com/policies/privacy/

10.2 Use of Google AdWords Conversion Tracking

This website uses the online advertising program “Google AdWords” and, as part of Google AdWords, the conversion-tracking functionality provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). We use Google AdWords to draw attention to our attractive offers on external websites using advertising media (called Google AdWords). In relation to the data of advertising campaigns, we can determine how successful the individual advertising measures are. Our goal here is to show you advertisements of interest to you, make our website more interesting for you, and achieve a fair calculation of advertising costs.

The cookie for conversion tracking is set when a user clicks on an advertisement placed by Google AdWords. These are small text files that are stored on your computer system. These cookies generally expire after 30 days and are not intended to identify you personally. If the user visits certain pages on this website and the cookie has not yet expired, Google and we can tell that the user clicked on the ad and was redirected to this page. Each Google AdWords client receives a different cookie, so cookies cannot be tracked across the websites of different AdWords clients. The information collected via the conversion cookie is used to generate conversion statistics for AdWords clients that have opted in to conversion tracking. Clients learn the total number of users who clicked on their ad and were redirected to a page tagged for conversion tracking. However, they do not receive any information that personally identifies users.

If you do not wish to participate in tracking, you can disable the Google conversion tracking cookie by making the appropriate setting in your internet browser under user preferences, thereby preventing you from being included in the conversion tracking statistics. We use Google AdWords on the basis of our legitimate interest in targeted advertising under Art. 6(1)(f) GDPR.

Google LLC in the USA is certified under the EU-U.S. “Privacy Shield,” which ensures compliance with EU data protection standards.

For more information about Google’s privacy policy, please visit: https://www.google.com/policies/privacy/

You can permanently disable cookies for advertising preferences by preventing them in your browser settings or by downloading and installing the browser plug-in available at: https://www.google.com/settings/ads/plugin?hl=en

Please note that certain functions of this website may not function or may be limited if you have disabled the use of cookies.

--------------------------------------------------------------------------------

11) WEB ANALYSIS SERVICES

Google (Universal) Analytics

This website uses Google Analytics, a web analytics service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). Google Analytics uses “cookies,” which are text files stored on your computer that allow us to analyze your use of the website. The information generated by the cookie about your use of this website (including the shortened IP address) is generally transmitted to and stored on a Google server in the USA.

This website uses Google Analytics exclusively with the “_anonymizeIp()” extension, which ensures that IP addresses are anonymized by truncation and precludes direct personal references. By means of this extension, your IP address is truncated by Google within member states of the European Union or other contracting states of the Agreement on the European Economic Area before transmission. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. In such exceptional cases, data processing occurs under Art. 6(1)(f) GDPR on the basis of our legitimate interest in the statistical analysis of user behaviour for optimization and marketing purposes.

On our behalf, Google uses this information to evaluate your use of the website, to compile reports on website activity, and to provide additional services related to the use of the website and the internet. The IP address transmitted by your browser in the context of Google Analytics is not combined with other Google data.

You can prevent cookies from being stored by adjusting your browser software accordingly; however, please note that in this case you may not be able to use all features of this website in full. You can also prevent Google from collecting the data generated by the cookie and related to your use of the website (including your IP address), as well as Google’s processing of that data, by downloading and installing the browser plug-in available at: https://tools.google.com/dlpage/gaoptout?hl=en

As an alternative to the browser plugin or in browsers on mobile devices, please click the following link to set an opt-out cookie that prevents Google Analytics from collecting data from this website in the future (this opt-out cookie only works in this browser and for this domain; if you delete your cookies in this browser, you must click the link again):

Deactivate Google Analytics

Google LLC in the USA is certified under the EU-U.S. “Privacy Shield,” ensuring compliance with EU data protection standards.

This website also uses Google Analytics for a cross-device analysis of visitor flows, which is conducted via a user ID. The first time you visit, a unique, permanent, and anonymized ID is assigned to you, which is set across devices. This allows interaction data from various devices and sessions to be linked to a single user. The user ID does not contain personal data and does not transmit such data to Google.

You can object at any time, with effect for the future, to the collection and storage of data via the user ID. For this, you must deactivate Google Analytics on all the systems you use (for example, in another browser or on your mobile device).

You can also do this by using the Google browser plug-in (https://tools.google.com/dlpage/gaoptout?hl=en). Alternatively, please click the following link to set an opt-out cookie, which will prevent Google Analytics from collecting data on this website in the future (this opt-out cookie is valid only in this browser and for this domain; if you delete your cookies, you must click the link again):

Deactivate Google Analytics

12) RETARGETING/REMARKETING/REFERRAL ADVERTISING

Facebook Custom Audience via the Pixel Method

This website uses the “Facebook Pixel” by Facebook Inc., 1 Hacker Way, Menlo Park, CA 94025, USA (“Facebook”). If explicit consent is given, user behaviour can be tracked after they have viewed or clicked on a Facebook ad. This procedure helps to evaluate the effectiveness of Facebook ads for statistical and market research purposes, and can help optimize future advertising measures.

The collected data is anonymous to us, meaning it does not allow us to draw conclusions about the users’ identity. However, Facebook stores and processes the data so that it can be linked to the respective user profile, and Facebook may use the data for its own advertising purposes in line with Facebook’s Data Policy (https://www.facebook.com/about/privacy/). You can enable Facebook and its partners to serve ads on and outside of Facebook. A cookie may be stored on your computer for these purposes. These processing activities only take place if explicit consent has been granted in accordance with Art. 6(1)(a) GDPR.

Consent to the use of the Facebook Pixel may only be declared by users older than 13 years of age. If you are younger, please request permission from your legal guardians.

Facebook Inc. in the USA is certified under the EU-U.S. “Privacy Shield,” ensuring compliance with EU data protection standards.

To disable the use of cookies on your computer, you can set your internet browser so that no more cookies can be stored on your computer in the future or that cookies already stored are deleted. If you disable all cookies, some features of our website may no longer function. You can also disable the use of cookies by third parties like Facebook on the following website of the Digital Advertising Alliance: https://www.aboutads.info/choices/

Google AdWords Remarketing

Our website uses the functions of Google AdWords Remarketing, through which we advertise this website in Google search results and on third-party websites. The provider is Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). For this purpose, Google places a cookie in your browser, which, using a pseudonymous cookie ID and on the basis of the pages you visit, automatically enables interest-based advertising. Processing is based on our legitimate interest in the optimal marketing of our website under Art. 6(1)(f) GDPR.

Additional data processing only takes place if you have consented to Google linking your web and app browser history with your Google Account and using information from your Google Account to personalize ads that you view online. If you are logged in to Google during your visit to our website in this case, Google will use your data along with Google Analytics data to create and define target audience lists for cross-device remarketing. For this purpose, Google temporarily links your personal data with Google Analytics data to form target groups.

You can permanently disable the placement of cookies for advertising preferences by downloading and installing the browser plug-in available at: https://www.google.com/settings/ads/onweb/

Alternatively, you can learn more about the placement of cookies from the Digital Advertising Alliance at www.aboutads.info and manage your settings there. Finally, you can set your browser so that you are informed when cookies are placed and can individually decide whether to accept them or exclude the acceptance of cookies in certain cases or generally. If you do not accept cookies, the functionality of our website may be limited.

Google LLC in the USA is certified under the EU-U.S. “Privacy Shield,” ensuring compliance with EU data protection standards.

13) RIGHTS OF THE DATA SUBJECT

13.1 The applicable data protection law grants you comprehensive data-subject rights (rights of access and intervention) vis-à-vis the controller regarding the processing of your personal data, which we will inform you about below:

• Right of access pursuant to Art. 15 GDPR: In particular, you have the right to receive information about your personal data processed by us, the purposes of processing, the categories of personal data processed, the recipients or categories of recipients to whom your data has been or will be disclosed, the planned storage period or the criteria used to determine this period, the existence of a right to rectification, erasure, restriction of processing, objection to processing, lodging a complaint with a supervisory authority, the origin of your data if not collected by us from you, the existence of automated decision-making including profiling, and, if applicable, meaningful information about the logic involved as well as the significance and intended consequences of such processing for you, and your right to be informed about the safeguards provided by Art. 46 GDPR when your data is transferred to third countries.

• Right to rectification pursuant to Art. 16 GDPR: You have the right to demand the immediate rectification of inaccurate personal data concerning you and/or the completion of your incomplete data stored by us.

• Right to erasure pursuant to Art. 17 GDPR: You have the right to demand the erasure of your personal data if the requirements of Art. 17(1) GDPR are met. This right does not apply, in particular, if processing is necessary for exercising the right to freedom of expression and information, for fulfilling a legal obligation, for reasons of public interest, or for establishing, exercising, or defending legal claims.

• Right to restriction of processing pursuant to Art. 18 GDPR: You have the right to demand the restriction of processing of your personal data for as long as the accuracy of your data, which you dispute, is verified; if you refuse the erasure of your data because of unlawful data processing and instead request restriction of the use of your data; if you need your data to establish, exercise, or defend legal claims once we no longer need this data after achieving our purpose; or if you have lodged an objection for reasons relating to your particular situation, pending verification of whether our legitimate grounds override yours.

• Right to notification pursuant to Art. 19 GDPR: If you have asserted the right to rectification, erasure, or restriction of processing against the controller, the controller is obliged to notify all recipients to whom the personal data concerning you was disclosed of this rectification or erasure of the data or restriction of processing, unless this proves impossible or involves disproportionate effort. You have the right to be informed about these recipients.

• Right to data portability pursuant to Art. 20 GDPR: You have the right to receive your personal data that you provided to us in a structured, commonly used, and machine-readable format or to request the transfer to another controller, where technically feasible.

• Right to revoke consent granted pursuant to Art. 7(3) GDPR: You have the right to revoke, at any time and with future effect, any consent once granted for the processing of data. In the event of revocation, we will immediately erase the data concerned unless further processing can be based on a legal basis allowing processing without consent. The lawfulness of the processing carried out on the basis of the consent until revocation remains unaffected.

• Right to complain pursuant to Art. 77 GDPR: If you believe that the processing of your personal data violates the GDPR, you have the right—without prejudice to any other administrative or judicial remedy—to lodge a complaint with a supervisory authority, particularly in the member state of your residence, workplace, or where the alleged infringement occurred.

13.2 RIGHT TO OBJECT

IF, IN THE CONTEXT OF A WEIGHING OF INTERESTS, WE PROCESS YOUR PERSONAL DATA ON THE BASIS OF OUR OVERRIDING LEGITIMATE INTEREST, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THIS PROCESSING WITH EFFECT FOR THE FUTURE FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION.

IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL CEASE PROCESSING THE DATA CONCERNED. HOWEVER, FURTHER PROCESSING IS RESERVED IF WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR PROCESSING THAT OUTWEIGH YOUR INTERESTS, FUNDAMENTAL RIGHTS AND FREEDOMS, OR IF THE PROCESSING SERVES TO ESTABLISH, EXERCISE, OR DEFEND LEGAL CLAIMS.

IF YOUR PERSONAL DATA IS PROCESSED BY US FOR DIRECT MARKETING PURPOSES, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSES OF SUCH ADVERTISING. YOU MAY EXERCISE YOUR RIGHT TO OBJECT AS DESCRIBED ABOVE.

IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL CEASE PROCESSING THE DATA CONCERNED FOR DIRECT MARKETING PURPOSES.

--------------------------------------------------------------------------------

14) PERIOD OF STORAGE OF PERSONAL DATA

The period for which personal data is stored is based on the respective statutory retention period (e.g. commercial and tax retention periods). After the expiry of this period, the corresponding data is routinely deleted if it is no longer required for the performance or initiation of a contract and/or if we have no legitimate interest in continuing to store it.
